Terms and ConditionsThis website (the "Site") is maintained by Survey Sampling International ("SSI").
1. Use of This Site
You may access and use this Site solely pursuant to these Terms and Conditions for your personal, non-commercial use. Any use other than as stated herein is strictly prohibited. You must be 18 years of age or older to be part of the SurveySpot panels. Participation in surveys is always optional. You may unsubscribe from the Panel at any time, see "Opt Out Policy" below.
2. Eligibility for Membership
This service is open to individuals who are 18 years of age and older or to minors who are 13 years of age and older and who have parental permission to open and maintain an account. If you do not qualify, please do not use our services. SSI may refuse services to anyone at any time, in its sole discretion.
3. Application and Passwords
You may access this site anonymously as a visitor and will not be required to provide personally identifiable information. However, in order to access certain services and content on the Site, such as surveys, you will be required to register to become a Member of SurveySpot. You must provide truthful information when applying to become a Member and may not use any aliases or other means to mask your true identity. If you provide any information that is untrue, inaccurate, not current or incomplete, to SSI or one of its agents, or SSI or one of it agents has reasonable grounds to suspect such information is untrue, inaccurate, not current or incomplete, SSI has the right to terminate your membership and refuse any and all current or future access to, or use of the Site, including the immediate forfeiture of any rewards or prizes accumulated. In order to access the member's area, you will be required to set up a user name and password. You are responsible for the security of your password and will be solely liable for any use or unauthorized use under such password. SurveySpot membership is specific to the one individual with a unique e-mail address, limited to one household member per physical address, and is the individual who registered and completed the demographic and other profile information sections.
Other conditions of membership
If a member does not participate in any survey during a 6 month period, SurveySpot may elect, in its sole discretion, to terminate their membership without notice. Other grounds for termination without notice include but are not limited to inadequate or untruthful survey responses, undeliverable e-mail address or mailboxes which are full after 3 attempts to contact the member and any other fact or condition that, in the sole discretion of SurveySpot, warrant such termination. When membership is terminated, SurveySpot will stop sending you email invitations to participate in surveys. Your rewards remain available for claim for 90 days following the date of termination. After that period, all rewards expire. As a condition of membership, you hereby waive and release any and all claims against SurveySpot and its affiliates arising from or related to such membership termination or rewards expiration.
4. Unauthorized Use
You may not use spiders, robots or other automated data mining techniques to catalog, download, store or otherwise reproduce or distribute content available on the Site or to manipulate the results of any panel, poll, survey or prize draws on the Site. You may not take any action to interfere with the Site or any other user's use of the Site, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing" the Site. You may not send unsolicited email, including promotions and/or advertising of products or services, through the Site or forge or mask your true identity in any email or posting. You may not frame portions of the Site within another website or alter the appearance of the Site. You may not establish links from any other website to any page of the Site without the express written permission of SSI, and in no event shall links to any page other than the home page be established. You are prohibited from posting or transmitting any threatening, libelous, defamatory, obscene, scandalous, or inflammatory material or any material that could otherwise violate any law. SSI will fully cooperate with any law enforcement authorities or court order, within the limits of any applicable law, requesting or directing SSI to disclose the identity of anyone posting any such information or materials.
5. Intellectual Property
All pages and content within this Site and related surveys, including but not limited to, text, graphics, audio, video, photographs, surveys, logos or other materials are the intellectual property of, or are authorized for use by, SSI and its licensors, business partners and affiliates, including all trademarks, service marks, copyrights, patents and trade secrets contained therein. You may not modify, copy, reproduce, create derivative works, republish, display, upload, post, transmit or distribute in any way content available on this site without the prior written consent of SSI.
6. Prize Draws, Promotions and Payment
From time to time SSI may offer or conduct prize draws, points programs or other promotions or programs in connection with this Site. All such services shall be subject to

7. Profile Updates
You agree to promptly notify SSI of any changes in personal and other information including but not limited to name, mailing address, phone number, e-mail address, and demographic information by updating such information as described herein. If you need to update or correct your personal information you may do so by visiting the Member's Area. SSI will retain your profile information in our database for the entirety of your membership. Your membership will be considered inactive after six months of not participating in surveys. If you choose to end your membership with SSI, you may automatically delete your profile information by clicking on http://www.surveyspot.com/svy/71 and you will no longer receive communications from SSI. You may also send an e-mail directly to http://www.surveyspot.com/svy/survey/ContactMemberServices.jsp requesting to be removed. E-mail links are provided on the site so that you may contact us directly with any questions or concerns you may have. Each e-mail we receive is read and responded to individually; please allow 2-3 working days for us to get back to you.
8. Opt-Out Policy
By becoming an SSI panel member, you agree to receive emails inviting you to participate in surveys that we feel may match your experiences and background. Participation in all surveys is always voluntary. From time to time, we will also e-mail newsletters to you to make you aware of new features or contests running on our site. You may update your profile information, including opting-out from any further participation, at any time, by following the unsubscribe procedures described herein.
9. Third-Party Information
This Site may contain (i) links to other websites not maintained by SSI or (ii) information about products or services of third parties. SSI does not independently verify the business practices of these third parties and makes no warranties on their behalf. The availability of any link or reference of any third party shall in no way constitute an endorsement by SSI of such third party. We encourage you when you leave our Site and to read the terms and conditions of each and every website that you visit. The information contained on this Site is for informational purposes only. The views and opinions expressed on this Site are not necessarily those of SSI.
10. Communications with SSI
Any communication or material you transmit to SSI by electronic mail or otherwise, including any data, questions, comments, panel responses, suggestions or the like is and will be treated as, non-confidential and non-proprietary, unless specifically indicated otherwise. Except to the extent expressly covered by our Privacy Policy, anything you transmit or post may be used by SSI or its affiliates for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, SSI is free to use any ideas, concepts, know-how or techniques contained in any communication you send to the Site without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and services using such information.

12. Disclaimer
The Site, including all content or services made available on or accessed through the Site, is provided "as is." To the fullest extent permissible by law, SSI makes no representations or warranties of any kind whatsoever for the content on the Site. Further, SSI disclaims any expressed or implied warranties, including, without limitations, non-infringement, title merchantability or fitness for a particular purpose. SSI does not warrant that the functions contained in the Site or any materials or content contained therein will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it will be corrected, or that the Site or the server that makes it available is free of viruses or other harmful components. In no event will SSI be liable under any theory of tort, contract, strict liability or other legal or equitable theory for any lost profits, lost data, lost opportunities, costs of cover, exemplary, punitive, personal injury/wrongful death, special incidental, indirect or other consequential damages, each of which is hereby excluded by agreement of the parties regardless of whether or not either party has been advised of the possibility of such damages.
13. Changes
All information posted on the Site is subject to change without notice. In addition, these Terms and Conditions may be changed at any time without prior notice. We will make such changes by posting them here. You should check this page for such changes frequently. Your continued access of the Site after such changes conclusively demonstrates your acceptance of those changes.
14. Indemnification
You agree to indemnify, defend and hold non-culpable SSI, its employees, directors, officers, agents and representatives from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorney's fees and expenses, arising from, or related to, any breach by you of any of these Terms and Conditions or applicable law.
15. Limitation of Liability
SSI shall in no event be liable for the loss of profits, goodwill or other special or consequential damages suffered by the members of the Site, clients, or others as a result of SSI's performance or non-performance under this agreement whether or not the possibility of such damages was disclosed to SSI or could have been reasonably foreseen by SSI.
SSI is neither responsible nor liable for, and respondent hereby waives any claim, action or remedy for, any damages, whether direct, indirect, incidental, special or consequential, or losses that result from participation in the surveys offered to SurveySpot members, or reliance on or use of information, services, or merchandise provided on or through the Site except where such liability is mandated by law.
You further acknowledge that SSI neither endorses the contents of advertisements or partner websites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising there from, or any fraud or other crime facilitated thereby.
16. General Compliance with Laws
You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of the Site.
17. Suspension and Termination
Without limiting any other remedies, SSI may, without any further notice, suspend or terminate your account if you fail to abide by the terms and conditions set forth herein.
18. Notices
Except as explicitly stated otherwise, any notices required hereunder shall be given by email to http://www.surveyspot.com/svy/survey/ContactMemberServices.jsp (in the case of SSI) or to the email address you provide to SSI during the registration process (in your case), or such other address as the party shall specify. Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, SSI may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to SSI during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.
19. Arbitration
Any controversy or claim arising out of or relating to this Agreement shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Fairfield County, Connecticut, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or SSI may seek any interim or preliminary relief from a court of competent jurisdiction in Fairfield County, Connecticut necessary to protect the rights or property of you or SSI pending the completion of arbitration.
20. Severability
If any part of these Terms and Conditions shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms and Conditions.
21. General
These Terms and Conditions shall be governed in all respects by the laws of the State of Connecticut without giving effect to that state's provisions regarding conflicts of laws. If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This document sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
