Incentive Rules:
In connection with offers to take surveys or participate in other marketing research activities made by Survey Sampling International ("SSI"), we offer incentives that are awarded in various ways. All incentives awarded to survey participants are governed by these Terms and Conditions.
1. The Incentive Program (as defined herein) and its benefits are provided to you at the discretion of SSI and SSI has the right to terminate the program, or to change these terms and conditions, the exclusive awards, or conditions of participation, in whole or in part, at any time, with or without notice to you. Such changes include increasing the amount of any incentive required to redeem any exclusive award, or the change or removal of any of the awards currently available, at any time, with or without notice to you. If SSI does provide notice of changes, it may do so by email, regular mail or by general posting on the Incentive Program website. Other examples of the types of changes to the Incentive Program that SSI may make are described in these rules. Although every effort has been made to ensure that the information on the Incentive Program web site is accurate, SSI is not responsible for typographical errors or omissions.
2. Incentives are offered in the form of credits ("dollars") which are credited to an account maintained by SSI. SSI will establish and maintain your account based on information furnished by you and will hold your incentives until you redeem them or until they are forfeited, in accordance with the Terms and Conditions specified below. This program is called the "Incentive Program."
3. In order for an account to be established in your name and your incentives properly credited to your account, you must complete the online form. To open an account you must provide SSI with complete and valid contact information, including your full legal name, home address, and valid email address. All account holders must be at least eighteen (18) years of age. No person may establish or maintain more than one (1) account with SSI, and each account must have a unique and valid email address and password. By completing the online form, you represent that you are at least eighteen (18) years of age and that the information you have provided to SSI is accurate and truthful in all respects and pertains to you and no other person. SSI reserves the right to terminate any duplicate accounts or any account established with untruthful information. YOU UNDERSTAND AND AGREE THAT ALL ACCUMULATED AMOUNTS IN ANY DUPLICATE ACCOUNT OR ANY ACCOUNT ESTABLISHED WITH UNTRUTHFUL INFORMATION WILL BE FORFEITED AND WILL BECOME THE PROPERTY OF SSI. Your account information (except information used generically for demographic purposes) will be made available to third parties only in accordance with the SSI Privacy Policy as amended from time to time, unless required to do so by law or order of a court or governmental agency, or as otherwise provided in these Terms and Conditions.
4. Your use of the Incentive Program and accumulation of any "dollars" hereunder are personal to you, and you may not use anyone else's "dollars" or assign, transfer, pool, "lend," sell, or exchange your "dollars" or your right to participate in the Incentive Program. You may use only one (1) password to open and access your account, and you may not use another account holder's password or allow anyone else to use your password, for any reason. SSI will not be responsible for any losses incurred through the use of your password by a third party. You agree to immediately notify SSI of any unauthorized use of your account or any other breach of security breach known to you.
5. SSI shall be the sole determiner in cases of suspected abuse, fraud, or violation of these rules and any decision made by SSI shall be final and binding. Fraud or abuse relating to the accrual of "dollars" or redemption of merchandise may result in forfeiture of accrued "dollars" as well as the termination of your account. You are solely responsible for any fraudulent use of your "dollars" due to the theft or the sharing of your password.
6. "Dollars" will be credited to your account only through your participation in qualitative or quantitative marketing research activities performed by SSI, and only in accordance with the specific incentive offer disclosed for each activity.
7. SSI will maintain a record of the incentives credited to your account and allow you to check the status of your account online by logging in. If you feel the incentive amounts credited to your account are incorrect, you must contact SSI by email and explain in full the basis of your dispute, attaching any relevant documents which offer evidence of the discrepancy. Upon receipt of your notice, we will investigate your claim and notify you of our decision to adjust or maintain the amount of incentives credited to your account, as we deem appropriate, within thirty (30) days. If we need additional time to decide your claim, we will notify you and will endeavor to render a decision as soon as reasonably practicable. Any decision by us with regard to such a claim will be final.
8. You may redeem your "dollars" at the time which your account reaches or exceeds $5.00 (except in the event of forfeiture, as provided in Sections 3, 9, 13, 14, and 15 of these Rules) by notifying us via the account payment request form provided by SSI at its website. You cannot redeem your incentives if the balance in your account is below $5.00. Every time you ask to redeem your incentives you must ask that all incentives credited to your account be redeemed at that time. You cannot request a partial redemption. Upon receipt of such notice from you, SSI will verify the amount in your account and will indicate to you the amount available for withdrawal. SSI will forward the account balance available for withdrawal to you within six (6) weeks from the receipt of your request in the form of a check. Additionally, you can request to have your incentive balance donated to a charity by selecting this option when you redeem your "dollars." See the FAQ's (https://www.surveyspot.com/FAQ.shtml) for a list of charities available to donate your "dollars." Once you have made a request to redeem the incentives credited to your account, the request cannot be withdrawn, cancelled, or postponed. AT NO TIME WILL INTEREST BE PAID ON ANY AMOUNTS CREDITED TO YOUR ACCOUNT, NOR WILL YOU BE ENTITLED TO ANY SUCH INTEREST.
9. If at any time after you have begun using the Incentive Program you become "inactive", incentives older than one (1) year accumulated in your account will expire and be forfeited. See the Terms and Conditions document for information on requirements for keeping your account active.
10. BY COMPLETING THE SIGN-UP FORM AND UTILIZING THE INCENTIVE PROGRAM, YOU ACKNOWLEDGE AND AGREE THAT SSI IS NOT A BANK OR ANY OTHER KIND OR FORM OF FINANCIAL INSTITUTION AND THAT SSI DOES NOT MAINTAIN YOUR ACCOUNT FOR ANY PURPOSE OTHER THAN THOSE SPECIFIED HEREIN. YOU FURTHER AGREE THAT THE "DOLLARS" CREDITED TO YOUR ACCOUNT ARE NOT ACTUAL CASH DEPOSITS AND ARE ONLY ACCOUNT ENTRIES THAT ENTITLE YOU TO THE AMOUNT OF THE CREDITED INCENTIVES IF YOU REDEEM THEM IN ACCORDANCE WITH THESE TERMS AND CONDITIONS. YOU FURTHER AGREE THAT YOU MAY ONLY REDEEM THE AMOUNTS IN YOUR ACCOUNT IN THE MANNER AND ACCORDING TO THE PROCEDURES DESCRIBED IN THESE TERMS AND CONDITIONS, WHICH WE MAY AMEND FROM TIME TO TIME.
11. You may be required under federal, state, and/or local laws to pay taxes on the "dollars" you redeem. You acknowledge that we may supply information to taxing agencies, or withhold taxes, at the request of those agencies or as we in our sole discretion deem appropriate. You acknowledge and agree that you will provide SSI with any additional personal information, such as social security number, that SSI needs to comply with any reporting or withholding obligations. Your failure to provide such information within 30 days of a request sent by SSI to the email address registered at that time will result in the forfeiture of your incentives.
12. SSI will not be responsible for supplying any hardware or software needed to access the Incentive Program, or for any charges associated therewith (including but not limited to telephone and Internet provider charges).
13. YOU MAY ACCESS THE INCENTIVE PROGRAM ONLY FOR THE PURPOSES THAT WE PERMIT. IF YOU USE OR ATTEMPT TO USE ANY PART OF THE INCENTIVE PROGRAM FOR ANY OTHER PURPOSE, YOU UNDERSTAND AND AGREE THAT YOUR RIGHT TO ACCESS THE INCENTIVE PROGRAM WILL CEASE AND ALL "DOLLARS" CREDITED TO YOUR ACCOUNT, HOWEVER AND WHENEVER ACCUMULATED, WILL BE FORFEITED AND WILL BECOME THE PROPERTY OF SSI. You may, in addition, be subject to an action for damages and/or criminal prosecution. Without limiting the above paragraph, misuse of the Incentive Program will include attempting to access the accounts of others, accessing your account in an attempt to change the amount of incentives credited, and opening multiple accounts. SSI reserves the right, in its sole discretion, to determine what other actions constitute misuse of the Incentive Program. SSI retains all rights to the Incentive Program. Any unauthorized copying or publication of the Incentive Program or any subject matter associated with the Incentive Program will constitute an infringement of SSI's rights under the copyright laws, and you will be subject to all damages and other penalties available under those laws, including but not limited to criminal prosecution.
14. You may cancel your account at any time by contacting SSI at https://www.surveyspot.com/svy/survey/ContactMemberServices.jsp or by accessing the following web page and requesting to be deactivated: https://www.surveyspot.com/svy/servlet/com.surveysampling.emailpanel.survey.servlets.RemovePanelistServlet. Your account will also be cancelled if you withdraw from the SSI panel. Immediately upon deletion or your withdrawal from the SSI panel, your account will be closed. Any "dollars" remaining in your account at the time of your withdrawal from the panel will be subject to the expiration clause in paragraph 9.
15. WE RESERVE THE RIGHT, IN OUR SOLE DISCRETION, TO MODIFY ANY PART OF THE INCENTIVE PROGRAM OR THESE TERMS AND CONDITIONS AT ANY TIME BY CHANGING THESE TERMS AND CONDITIONS OR RELATED INFORMATION ON OUR WEBSITE. This includes, without limitation, the right to change the rules of participation, terminate your participation, and discontinue the Incentive Program. If there is a modification to the Incentive Program, we will endeavor to notify you; however, we will not be responsible if you do not learn of the modification. SSI does not warrant that the Incentive Program will remain operational, and we disclaim any liability for any losses you experience because the Incentive Program is not operational or accessible by you. IF SSI DISCONTINUES THE INCENTIVE PROGRAM OR IF WE TERMINATE YOUR PARTICIPATION FOR VIOLATION OF THIS AGREEMENT, YOU UNDERSTAND AND AGREE THAT YOUR RIGHT TO ACCESS THE INCENTIVE PROGRAM WILL CEASE AND ALL "DOLLARS" IN YOUR ACCOUNT, HOWEVER AND WHENEVER ACCUMULATED, WILL BE FORFEITED AND WILL BECOME THE PROPERTY OF SSI.
16. SSI provides the Incentive Program "as is" and makes no representations or warranties to you, express or implied, regarding its accessibility or that your access to the Incentive Program will be uninterrupted or error-free. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some states do not allow limitations on how long an implied warranty may last, so the above limitation may not apply to you.
17. YOU ACCEPT ALL RESPONSIBILITY FOR, AND HEREBY INDEMNIFY AND HOLD HARMLESS SSI FROM AND AGAINST, ANY ACTIONS TAKEN BY ANY USER AUTHORIZED TO USE YOUR ACCOUNT, INCLUDING BUT NOT LIMITED TO ACCRUAL OR REDEMPTION OF "DOLLARS," AND DISCLOSURE OF PASSWORDS TO THIRD PARTIES. BY USING THE INCENTIVE PROGRAM, YOU RELEASE SSI AND ITS AGENTS FROM ANY AND ALL LIABILITY REGARDING THE REDEMPTION OF "DOLLARS," USE OF MERCHANDISE, OR OTHER PARTICIPATION IN THE INCENTIVE PROGRAM.
18. You acknowledge that SSI neither endorses the contents of advertisements or partner websites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising therefrom, or any fraud or other crime facilitated thereby.
19. SSI is not responsible and assumes no liability for any changes or discontinuances of service from providers, which may affect offers, or the accrual of "Dollars."
20. Notwithstanding anything else in these Terms and Conditions, SSI will not be liable for any incidental or consequential damages (including but not limited to loss of profits or revenue, loss of use of a product, cost of capital, cost of substituted services or products, downtime costs, labor costs, or claims of customers) with respect to any claim or action related to the subject matter hereof. Some states do not allow limitations on incidental or consequential damages, so the above limitation may not apply to you.
21. You agree to indemnify and hold SSI, its agents, affiliates, officers and employees harmless from any claim, demand, expense or damage, including reasonable attorneys' fees relating to your use of the Incentive Program or your violation of this Agreement.
22. SSI takes reasonable measures to maintain the security and confidentiality of your personal account information. There are certain conditions, however, that exist on the Internet generally which are outside SSI's control and could result in a breach of security. Accordingly, we cannot guarantee that your confidential information will be free from corruption or privacy. You hereby expressly waive any claim against SSI and its members, officers, directors, employees, agents, and representatives, arising out of the loss of data through corruption, piracy, breach of security, or other reason.
23. SSI's performance under these Terms and Conditions is subject at all times to existing laws and legal process, and nothing in these Terms and Conditions limits or restricts SSI's rights, duties, and obligations to comply with all applicable laws or legal process served on SSI with respect to you or your use of the Incentive Program.
24. No delay by SSI in enforcing these Terms and Conditions shall constitute a waiver of any breach hereof, and no waiver by SSI of any breach of these Terms and Conditions shall constitute a waiver of any future breach.
25. These Terms and Conditions are governed by and shall be construed under the laws of the State of Connecticut, USA (without regard to its conflicts of law provisions). Any controversy or claim arising out of or relating to this Agreement shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Fairfield County, Connecticut, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or SSI may seek any interim or preliminary relief from a court of competent jurisdiction in Fairfield County, Connecticut necessary to protect the rights or property of you or SSI pending the completion of arbitration. You will comply with all such laws and with the laws of the United States that apply to the Incentive Program and the use of any "dollars" in your account, and any laws of your country and state or province of residence. The Incentive Program and these Terms and Conditions, or relevant portions thereof, are void where prohibited by law.
26. SSI retains all right, title and interest to its trademarks, its logos, phrases and any other content or material embodying or consisting of patentable or copyrightable work on the Incentive Program website ("SSI Intellectual Property"). The content of the incentive Program and its website is intended for the personal, noncommercial employment of its users, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content, including from the SSI Intellectual Property.
27. All other trademarks and or copyrights appearing on the Incentive Program pages are the property of their respective owners, and unless otherwise stated, SSI Interactive and the respective owners of said intellectual property are not affiliated.
